Welcome to Cycle, a cutting-edge AI-powered assistant designed to enhance productivity and creativity. By accessing or using our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use Cycle.

2. Eligibility

You must be at least 18 years old to use Cycle. By using our services, you confirm that you meet this age requirement and are fully able and competent to enter into these Terms. Our service is primarily targeted at users in Europe, the USA, and Canada. If you are accessing Cycle from outside these regions, you do so at your own risk and are responsible for compliance with local laws.

3. User Accounts

Account Creation: To use certain features of Cycle, you may need to create an account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer.
Account Termination: We reserve the right to suspend or terminate your account at our discretion if you violate any of these Terms. Upon account termination, all personal information associated with your account will be permanently deleted from our servers.

4. User Conduct

Prohibited Activities: You agree not to use Cycle for any unlawful purposes or in a manner that could damage, disable, overburden, or impair our services. Prohibited activities include, but are not limited to, harassing other users, transmitting viruses, and engaging in spamming activities.
Content Ownership and Responsibility: You are solely responsible for any content you generate or share through Cycle. You retain ownership of your content, but you grant Cycle a non-exclusive, worldwide, royalty-free license to use, reproduce, and display this content for the purpose of providing and improving the service.

5. Service Usage

License to Use: We grant you a limited, non-exclusive, non-transferable license to access and use Cycle for personal or internal business purposes, subject to these Terms.
Modifications to the Service: We may modify or discontinue any part of Cycle at any time without notice. In the event of significant changes, we will notify you via the email address associated with your account.

6. Payment and Subscription Terms

Pricing: If you subscribe to Cycle’s premium services, you agree to pay the fees associated with the chosen plan. Payments are processed securely through Stripe. We reserve the right to adjust pricing at any time.
Refund Policy: We do not offer refunds except as required by law.

7. Intellectual Property

Ownership: All intellectual property rights in and to Cycle, including software, branding, and content, are owned by Cycle or our licensors.
User-Generated Content: By using Cycle, you grant us the right to use, display, and modify any content you create for the purpose of providing our services.

8. Privacy Policy

Data Collection: We respect your privacy. Currently, Cycle does not collect personal data except for conversations with the AI assistant, which are used solely for the purpose of improving user experience. We do not exploit, share, or sell any user data.
Data Deletion: Upon your request to delete your account, we will permanently erase all personal information from our servers.
Integration with Third-Party Services: Cycle utilizes OpenAI’s GPT models, which means your interactions with our AI may be subject to OpenAI’s Terms of Service and Privacy Policy. By using Cycle, you agree to comply with these terms.
Compliance Efforts: While Cycle aspires to comply with SOC2 and GDPR standards, as a startup, achieving full compliance is a work in progress. We are committed to enhancing our data security measures and adhering to relevant data protection regulations as we grow.

At Cycle, we prioritize your privacy. We do not use cookies or any tracking technologies to monitor or collect data from your interactions on our platform. Our focus is on delivering a seamless and secure user experience without intrusive tracking practices.

10. Third-Party Services

Links and Integrations: Cycle may include links to third-party services, which are not under our control. We are not responsible for the content or practices of these third-party services.
Third-Party Content: We integrate with OpenAI’s ChatGPT models, and your use of these services is subject to OpenAI’s Terms of Service.

11. Connectors Data Usage

Cycle’s connectors are designed solely to facilitate integrations and ensure smooth functionality. We do not use data obtained through connectors to fine-tune, train, or improve generalized AI or machine learning models. Any data transmitted via connectors is retained in our database for a maximum period of one (1) month strictly for debugging purposes. After this period, such data is permanently deleted from our systems. This retention policy exists solely to help diagnose and resolve technical issues, and the data is not exploited for any other purpose.

12. Disclaimer of Warranties

“As Is” Service: Cycle is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the service, including but not limited to its reliability, availability, or suitability for your needs.

13. Limitation of Liability

No Liability: To the fullest extent permitted by law, Cycle shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.
Maximum Liability: In no event shall Cycle’s total liability to you exceed the amount paid by you for using our services.

14. Indemnification

You agree to indemnify, defend, and hold harmless Cycle, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of your use of the service or your breach of these Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France. Any legal actions or proceedings arising from or related to these Terms shall be brought exclusively in the courts located in France.

16. Alpha Terms

Alpha Service: By using Cycle’s alpha services, you understand that these features are still under development and may contain bugs or errors. The alpha services are provided on an “as is” basis and may be subject to change at any time.
Feedback: We welcome and encourage feedback during the alpha phase. By providing feedback, you grant Cycle a perpetual, irrevocable, royalty-free license to use, modify, and incorporate your feedback into the services without any obligation to you.
No Guarantee: Participation in the alpha phase does not guarantee continued access to the alpha features or their inclusion in the final version of the product.
User-Centric Development: Feedback from our users is integral to the evolution of Cycle. We aim to empower our community by giving them a voice in shaping the product.

17. Changes to the Terms

We reserve the right to update or modify these Terms at any time. If we make significant changes, we will notify you by email or through a prominent notice on our service. Your continued use of Cycle after any changes indicates your acceptance of the new Terms.
